These Service Terms (“

Terms

”) govern use of the Happiest Ours platform, website, and related services (collectively, the “

Platform

”) by customers booking bartending services (“

Customers

”). The Platform is operated by Happiest Ours Technologies, Inc. (“

By requesting a quote, booking a service, or paying for services through the Platform, you agree to these Terms.

1. Marketplace Role

1.1

Platform Only.

Happiest Ours is a technology marketplace that connects Customers with independent bartending businesses and personnel (“

Service Providers

”).

1.2

Independent Providers.

Service Providers are independent businesses, not employees, agents, joint venturers, or legal representatives of Happiest Ours.

1.3

No Alcohol Retail Sales by Platform (unless expressly stated).

Any alcohol-related fulfillment is handled by properly licensed third parties where legally permitted and subject to separate alcohol terms.

2. Eligibility and Legal Compliance

2.1 You must be at least 18 years old to book services and 21+ where alcohol service is involved.

2.2 You agree to comply with all applicable laws, venue rules, HOA/community restrictions, and permit requirements.

2.3 Service Providers may refuse service that would violate law, safety, or responsible beverage service obligations.

3. Quotes, Booking, and Payment

3.1

Booking Confirmation.

A booking is confirmed only after required payment is successfully processed.

3.2

Service Total.

Your total charge may include labor, travel, rentals, supplies, and applicable taxes/fees as shown at checkout.

3.3

Payment Method.

You authorize Happiest Hours and its payment processor(s) to charge your selected payment method for all amounts due under these Terms.

3.4

Extensions/Overages.

Any approved event-time extensions, add-ons, or overtime may be charged at the rates disclosed in your booking details and may be collected by platform charge and/or directly by the Service Provider as disclosed in booking terms.

4. Cancellation and Refund Policy (Universal)

4.1

Non-Refundable Booking Fee (10%).

A

4.2

Customer Cancellations.

Cancellation charges are based on the scheduled event start time:

  • More than 7 days before event:

    Customer is charged

    10%

    of the Service Total (non-refundable Booking Fee).

  • 7 days to 48 hours before event:

    Customer is charged

    30%

    of the Service Total.

  • Less than 48 hours before event or no-show:

    Customer is charged

    60%

    of the Service Total.

Any prepaid amount above the applicable cancellation charge is refundable.

4.3

Service Provider Cancellation.

If a Service Provider cancels and no replacement acceptable to Customer is secured, Customer receives a full refund of amounts paid.

4.4

Reschedule Option.

Happiest Ours may, in its discretion, offer a one-time reschedule credit instead of immediate refund, subject to provider availability and stated credit expiry terms.

4.5

Refund Timing.

Approved refunds are returned to the original payment method. Processing times vary by processor and card issuer/bank.

5. Event Terms and Operations

5.1

Arrival/Setup.

Target setup/arrival windows are estimates and may vary due to traffic, venue access, security, weather, or other operational issues.

5.2

Guest Count and Scope.

Customer must provide accurate event details (guest count, venue, service duration, menu requests). Material changes may require repricing.

5.3

Supplies and Equipment.

Included items are those expressly listed in the booking confirmation.

5.4

Damage/Missing Property.

Customer is responsible for loss or damage to rented/provided equipment caused by Customer or guests, reasonable wear and tear excepted.

5.5

Unsafe or Illegal Conditions.

Service may be limited or terminated without refund for illegal activity, unsafe conditions, harassment, threats, or refusal to follow lawful service protocols.

6. Alcohol Service Rules

6.1 No service to persons under 21 or visibly intoxicated persons.

6.2 Valid government-issued ID is required for age verification where requested.

6.3 All alcohol service must comply with applicable state/local law and responsible beverage service requirements.

6.4 Customer is responsible for ensuring event environment allows legal and safe service.

7. Customer Responsibilities

You agree to:

  • provide accurate booking information,

  • ensure legal right to use venue for event activities,

  • provide safe and reasonable working conditions,

  • ensure compliance with venue and local rules,

  • cooperate in resolving disputes and charge issues before initiating chargebacks.

8. Fees, Taxes, and Chargebacks

8.1 Applicable taxes and required fees may be added at checkout where required by law.

8.2 If a chargeback is filed for a valid charge under these Terms, Happiest Ours may contest the dispute and/or suspend account access pending resolution.

8.3 You remain responsible for non-refundable amounts and valid cancellation charges described herein.

9. Insurance and Liability

9.1 Service Providers may carry their own insurance; Customer should verify venue-specific insurance requirements.

9.2 To the maximum extent permitted by law, Happiest Ours disclaims liability for acts/omissions of independent Service Providers.

9.3 Happiest Ours’ total aggregate liability arising out of or relating to the Platform shall not exceed the amounts paid by Customer to Happiest Ours for the specific booking giving rise to the claim.

10. Disclaimer of Warranties

The Platform is provided “as is” and “as available.” Happiest Ours disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11. Indemnification

Customer agrees to defend, indemnify, and hold harmless Happiest Ours and its affiliates, officers, directors, and employees from claims, damages, liabilities, and expenses arising out of Customer’s event, venue violations, unlawful conduct, or breach of these Terms, except to the extent caused by Happiest Ours’ gross negligence or willful misconduct.

12. Dispute Resolution; Governing Law

12.1

Governing Law.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

12.2

Venue.

Unless otherwise required by law, disputes shall be brought in state or federal courts.

13. Privacy

Use of the Platform is also governed by our Privacy Policy: https://happiestours.com/privacy/

14. Modifications

Happiest Ours may update these Terms from time to time. Updated Terms are effective when posted with revised “Last Updated” date. Continued use of the Platform after updates constitutes acceptance.
